Disclaimer – legal information

Right to information and right of withdrawal

You have the right at any time to inquire immediately and free of charge about the data collected about you. You can also withdraw your consent to the use of your personal data provided with future effect. For this, please contact the service provider specified in the imprint.

Data privacy (general)

In principle, the website can be used without providing personal data. Insofar as personal data (e.g. name, address or email addresses) are collected, this is always done on a voluntary basis as far as possible. This data will not be passed on to third parties without your express consent.

If a contractual relationship is to be established, the content is to be modified or changed or you send us an inquiry, we will collect and use personal data from you insofar as this is necessary for this purpose (inventory data). We collect, process and use personal data insofar as this is necessary to enable you to use the website (usage data). All personal data will only be stored for as long as is necessary for the stated purpose (processing your request or processing a contract). We take account of tax and commercial retention periods. On an order from the responsible authorities, we must provide information on this data (inventory data) in individual cases, insofar as this is necessary for the purposes of law enforcement, security, to fulfill the statutory duties of the constitutional protection authorities or the military shielding service or to enforce intellectual property rights.

We expressly point out that data transmission over the Internet (e.g. when communicating by email) can have security gaps. You cannot completely protect against access to data.

The use of contact data published within the framework of the imprint obligation by third parties for sending unsolicited advertising and information materials is hereby expressly prohibited. Exceptions to this are existing business relationships or you have the appropriate consent from us.

The providers and all third parties mentioned on this website expressly reserve the right to take legal action in the event that unsolicited advertising information is sent. The same applies to the commercial use and transfer of the data.

Privacy policy Facebook plugins (like button etc.)

This website contains plugins from the social media provider Facebook.com (for Europe: Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland; for the USA: Facebook Inc., 1601 Willow Road, Menlo Park, CA 94025, USA), implemented. An overview of the Facebook plugins can be found here: https: //developers.facebook.com/docs/plugins/.

When you visit pages with Facebook plugins, the plugin creates a connection between your browser and a Facebook server. This gives Facebook information about your IP address and your visit to our website.

By clicking on the Facebook plugins you will get to the Facebook login area. Facebook users who are already logged in can immediately publish the content of our website on their Facebook profiles. As a result of using these plugins, Facebook can assign your visit to our website to your personal user account. We expressly point out that, as the provider of this website, we have no knowledge of the content of the transmitted data or its use by Facebook. Further information on data protection by Facebook can be found at: https://de-de.facebook.com/policy.php.

To prevent Facebook from assigning your visit to our website to your user account, you must log out of your Facebook account.

Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”), 1600 Amphitheater Parkway, Mountain View, CA 94043, USA. Google Analytics uses so-called “cookies” (text files), which are saved on your computer and which enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. If IP anonymization is activated on this website, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and anonymized there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with other services related to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You can prevent the storage of cookies by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by using the browser add-on available under the following link on download and install: http: //tools.google.com/dlpage/gaoptout? hl = de. The browser add-on for deactivating Google Analytics is compatible with Chrome, Internet Explorer 8 to 11, Safari, Firefox and Opera.

Further information on terms of use and data protection can be found under the following links: http: //www.google.com/analytics/terms/de.html and https://www.google.de/intl/de/policies/.

As a service provider, we are responsible for our own content on these pages in accordance with general laws in accordance with Section 7 (1) TMG. According to §§ 8 to 10 TMG, we as a service provider are not obliged to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information according to general laws remain unaffected. However, liability in this regard is only possible from the time we become aware of a specific legal violation. As soon as we become aware of such violations, we will remove this content immediately.

2. Liability for links

This website contains links to external websites of third parties, the content of which cannot be influenced. Therefore, no liability can be assumed for this external content. The respective provider or operator of the pages is always responsible for the content of the linked pages. The linked pages were checked for possible legal violations at the time the link was created. No illegal content was discernible at the time the link was created. A permanent control of the content of the linked pages is not reasonable without concrete evidence of an infringement. Credentials

To register for the newsletter, it is sufficient to provide your email address.

Optionally, we ask you to provide your first and last name. This information only serves to personalize the newsletter. We also ask you to optionally provide your date of birth, gender and your industry. We only use this information to adapt the content of the newsletter to the interests of our readers.

Statistical survey and analysis

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval are initially collected. This information is used to technically improve the services based on the technical data or the target groups and their reading behavior based on their access locations (which can be determined using the IP address) or the access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is neither our aim nor that of MailChimp to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Online access and data management

There are cases in which we direct the newsletter recipients to the MailChimp website. For example, our newsletters contain a link with which the newsletter recipients can access the newsletters online (e.g. if there are display problems in the email program). Newsletter recipients can also save their data, e.g. correct the email address later. Likewise, MailChimp’s privacy policy is only available on their website.

In this context, we would like to point out that cookies are used on the MailChimp website and thus personal data are processed by MailChimp, its partners and service providers (e.g. Google Analytics). We have no influence on this data collection. You can find further information in MailChimp’s data protection declaration. We would also like to point out the options for objection to data collection for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European region).

Termination / Revocation

You can cancel the receipt of our newsletter at any time, i.e. Withdraw your consent. This will simultaneously expire your consent to its dispatch via MailChimp and the statistical analyzes. A separate revocation of the dispatch via MailChimp or the statistical evaluation is unfortunately not possible.

You will find a link to cancel the newsletter at the end of each newsletter.

Notes on the newsletter and consent

With the following information, we will clarify the content of our newsletter as well as the registration, shipping and statistical evaluation procedure as well as your right to object. By subscribing to our newsletter, you agree to the receipt and the procedures described.

Content of the newsletter

We send newsletters, e-mails and other electronic notifications with advertising information (hereinafter “newsletter”) only with the consent of the recipient or with a legal permission. Insofar as the content of a newsletter is specifically described, it is decisive for the consent of the user. In addition, our newsletters contain information about legal issues, in particular from the area of marketing law, data protection and about our law firm (this may include references to blog posts, lectures or workshops, our services or online presence).

Double opt-in and logging

The registration for our newsletter takes place in a so-called double opt-in procedure. That After registering, you will receive an email asking you to confirm your registration. This confirmation is necessary so that nobody can register with someone else’s email address.

The registrations for the newsletter are logged in order to be able to demonstrate the registration process in accordance with the legal requirements. This includes storing the time of registration and confirmation, as well as the IP address. Changes to your data stored at MailChimp are also logged.

Use of the shipping service provider “MailChimp”

The newsletter is sent using “MailChimp”, a newsletter delivery platform from the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE # 5000, Atlanta, GA 30308, USA.

The email addresses of our newsletter recipients, as well as their other data described in the context of this information, are stored on MailChimp’s servers in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. According to its own information, MailChimp can also use this data to optimize or improve its own services, e.g. for the technical optimization of the dispatch and presentation of the newsletter or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them themselves or to pass them on to third parties.

We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement “Privacy Shield” and is therefore committed to complying with EU data protection regulations. Furthermore, we have concluded a “data processing agreement” with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it in accordance with its data protection regulations on our behalf and, in particular, not to pass it on to third parties. You can view MailChimp’s privacy policy here.

Legal basis of the General Data Protection Regulation

In accordance with the requirements of the General Data Protection Regulation (GDPR) that will apply from May 25, 2018, we inform you that the consent to the sending of email addresses is based on Art. 6 Para. 1 lit. a, 7 GDPR and Section 7 Paragraph 2 No. 3 and Paragraph 3 UWG. The use of the mail service provider MailChimp, the implementation of statistical surveys and analyzes and the logging of the registration process are based on our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR. We are interested in the use of a user-friendly and secure newsletter system that serves both our business interests and the expectations of the users.

We would also like to point out that you are responsible for the future processing of your personal data in accordance with the legal requirements in accordance with 21 GDPR at any time. The objection can in particular be made against processing for direct marketing purposes.
